In a year when it seems everywhere you look in the news, if the President is in it then there is someone else in it that is in opposition to him. The latest organization to do so is a very unlikely group of characters thought to be some of the nations biggest constitutional scholars of the time- The Supreme Court.
Jose Ernesto Medellin, a Mexican citizen, is sitting on death row in a Texas penitentiary found guilty of raping and murdering two teenage girls, 14 and 16, as a gang member in Houston in 1995.
Hey I am good with that. Let that be known from the start. An eye for an eye, a life for a life. That’s me, that’s my belief.
“So what’s the beef DB?”
Breakin’ it down in a way that even I can understand it. The President has said that the state of Texas should NOT execute this man due to the fact that his “rights” were violated and that they should reopen the case based on that to see if it would have changed the outcome of the trial. Now listen- The President is no soft on crime man and in fact he sent 152 killers to meet their makers while the Governor of Texas.
It’s this simple- the 1963 Vienna Convention Treaty which we signed, provides that people arrested abroad should have access to their home country’s consular officials. Does this mean that if you screw up in a country you’re not from then you get a get out of jail free card? NO, it means that if you screw up in a country you’re not from that you will be given the chance to contact someone from your government to say “hey I screwed up, how can I get some help? what is the law here?” etc etc etc. This didn’t happen with this guy, who also happened to be an illegal immigrant.
Bush is trying to do the right thing by saying that the state of Texas not nuke this guy quite yet. Highlighting the case and bringing to the forefront the policies that have in the past let murders walk free. The Miranda laws state that a person has the right to stay silent, have a lawyer bla bla, but it doesn’t state that you have a right to talk to your government- it should. Other countries around the world have denied US citizens of this very right as well and by not living up to the treaty we signed it gives those countries more encouragement to continue their practices.
The Supreme Court however in the most aggressive position taken from it’s learned halls in recent memory said that the US essentially does not have to listen to the “World Court” when it comes to matters involving States Rights, and the US is under no obligation to do so, which is absolutely true.
The Supreme Court is taking this opportunity to interject some common sense back into American policies that have in recent years given way to international laws over that of US laws. Good for them. Good for us. Screw the international laws, this is America we have our own brand of justice. And, in Texas if you kill someone you are going to face the death penalty.
So the President while trying to provide a diplomatic voice to the world is actually strengthening US sovereignty from moving it away from international laws that have tried to dictate US policies for some time. It’s a good and I’m sure thought out maneuver, or just a happy coincident.
Yahoo did a three paragraph story, it pretty much is some of the worst writing on the net;

This is a great comprehensive break down of the courts decision and the law;

I think we have turned some cornor here, or I hope we have. Has the Supreme Court strengthened America from the would be rule of the “world court”? Have we finally reached a point where international laws do not govern Americans? I certainly hope so, and I certainly hope that the socialist in this country have taken notice- we’re taking our country back you sons of bitches.

Thank God… the Supreme Court decided to side with American sovereignty. This will be a great precedent for future cases that would involve our sovereignty.

This is a tragedy. We are, like it or not, part of the international community. This ruling, in effect, says that America is above the law. That’s a very dangerous place to be.

Above the law? Maybe above their laws. Like it or not we are Americans, we are governed by the laws of our country and not that of others. If you look around the world today how many countries do you think have a wonderful judicial system?
Get shot on the spot for drinking and driving in places like Saudi Arabia- no due process just dead. Or how about the stoning of women who are rumored to be having an affair. The list is as endless as the night is dark here but I think you get my point. We govern ourselves, no one else- no country, no union has the rights to dictate to americans what we are or are not allowed.
It’s bad enough that our own government has been allowed to come into our lives, bedrooms, boardrooms, diners etc etc etc… now you would have another country as well? I don’t know about yours, but my bedroom is plenty full as is.
